Brief Overview And Experience

Augustine is partner at Kampala Associated Advocates (KAA) and co-heads the Telecommunications, Media and Technology practice in addition to being the practice head Employment Law and Intellectual Property Law. He holds a Masters degree in Information Technology and Communications Law from the University of Oslo, Norway. Augustine brings on board over 12 years’ experience as a lawyer and uniquely practices both transactional and litigation law. He has experience practicing telecommunications and technology law, employment law, intellectual property law among others in Uganda. He has represented and continues to act for the leading communications sector players in many industry ground breaking litigation and transactional matters. For the period 2012 to March 2015, Idoot Augustine was responsible for the delivery of work and execution of instructions on behalf of the Omukama/King of Bunyoro-Kitara Kingdom, H.R.H. Rukirabasaija Solomon. G. Iguru, first in his personal capacity as a beneficiary in the personal estate of the deceased Sir Tito Winyi Gafabusa and later in his capacity as the Omukama of Bunyoro Kitara Kingdom. He has also represented the key Oil Sector players involved in the Oil and gas exploration within the Kingdom of Bunyoro mostly in relation to Land Compensation matters and disputes. Augustine continues to receive key mandates from some of the leading private sector actors in relation to their Employment law disputes, Intellectual Property interests and Telecommunications, Data and Privacy compliance related matters.

Key Experience Record

Represented the King of Bunyoro- Kitara Kingdom in relation to the restitution of property and Land by the Government of Uganda to the Omukama/ King of Bunyoro-Kitara Kingdom in Hoima District, Masindi District, Kiryandongo District and Buliisa District pursuant to the Traditional Rulers (Restitution of Assets and Properties) Act, Cap. 247.

Represented key Oil & gas sector players in relation to various suits and compensation claims from various claimants in Bunyoro region.

Successfully represented the Uganda Communications Commission in a suit instituted by a broadcaster regarding the suspension of its broadcasting license arising from the infringement of the minimum broadcasting standards.

Advised as sub-contracted consultant (Local Legal consultant) on a Gap Analysis of the Policy, Legal and Regulatory Framework for Uganda’s ICT Sector undertaken on behalf of the Ministry of ICT and National Guidance through the National Information Technology Authority- Uganda (NITA-U).

Advised as a consultant on the Review of the Licensing Framework in the Telecommunications Sector in Uganda pursuant to the Uganda Broadband Policy, 2018.

Advised a number of local companies in relation to the regulatory and statutory compliance requirements under the Data Protection and Privacy Act.

Represented key Oil & gas sector players in relation to various suits and compensation claims from various claimants in Bunyoro region.

Advised a number of local FINTECH start-ups on the legal and regulatory compliance requirements in relation to the provision of electronic money in Uganda before and after the passing of the National Payment Systems Act, 2020.

Successfully defended the Uganda Communications Commission together with MTN Uganda Limited, the leading Telecommunications provider in Uganda, in a landmark litigation instituted against them relating to the provision of mobile money service, as a value added service.

Negotiated and drafted the agreement for the supply, installation and maintenance of the core banking software called Orbit-R.

We recovered a domain name from cyber squatters/ cyber fraudsters, on behalf of Speke Hotel (1996) Ltd, who had registered a misleading domain name and we pursued the Complaint with the World Intellectual Property Organization (WIPO) Arbitration and Mediation Center (the Center) pursuant to the Uniform Domain Name Dispute Resolution Policy (the Policy) approved by the Internet Corporation for Assigned Names and Numbers (ICANN).

Successfully represented various clients in relation to the registration, renewals and enforcement of their Intellectual Property interests including Trademarks and Copyrights.

Successfully represented Uganda Communications Commission in an arbitration dispute worth UGX.13,000,000,000/= (Thirteen billion shillings) instituted by its former employees arising from a restructuring exercise (undertaken) by the Commission.

Has advised numerous clients in the negotiation and implementation of Collective Bargaining Agreements and Mutual recognition with the same Labour Unions.

Represented MTN Uganda Limited in the investigations and successful prosecution of former employees who had been suspected and ultimately proved to have committed numerous incidents of mobile money fraud through the ICT platform for the provision of mobile money.

Successfully represented the Uganda Communications Commission (UCC) in respect of a suit lodged by a private citizen challenging the Digital Migration exercise undertaken by the Uganda Communications Commission (UCC) under the Digital Migration Policy of 2011.

Successfully defended Uganda Communications Commission in the first suits instituted in Uganda regarding the temporary suspension of some over the top platforms (social media websites).

Successfully represented MTN Uganda Limited up to the Supreme Court in the only industry case that has ever been litigated in Uganda relating to payments under an Interconnection Agreement between Uganda Telecom Limited and MTN Uganda Limited for international traffic that was being terminated in the network of a third party telecommunications company in a foreign country in as much as the code used was a Ugandan code.

Representing MTN Uganda Limited in a number of novel litigation matters in the field of Intellectual Property (Trademarks) litigation relating to its advertising (Image rights) and the Mobile Money software (Copyright claims) and the Trademarks related thereto.
